ESMA updates Q&As on market structure, market abuse and short selling

The European Securities and Markets Authority has updated its Q&A documents covering MiFID II market structure, the Market Abuse Regulation and the Short Selling Regulation. The move forms part of ESMA’s broader simplification and burden-reduction initiative. According to the Techub News digest, the regulator removed guidance it considers outdated, duplicative or no longer relevant. ESMA said the purpose of the revision is to cut unnecessary complexity, withdraw obsolete guidance and keep its Q&A documents aligned with the current legislative framework. The update is also intended to ensure the documents remain relevant, proportionate and consistent with existing rules.

Hyperliquid receives 15 million USDC for HYPE buyback plan

Hyperliquid has received 15 million USDC, with the funds earmarked specifically for a buyback program tied to the HYPE token. The update was reported by Techub News and cited Crypto Briefing. Separately, Hyperliquid’s policy committee had earlier submitted feedback to the European Union on the evolution of the Markets in Crypto-Assets regulation, or MiCA. The committee also urged regulators to bring on-chain perpetual contracts within the scope of the MiFID II framework. The report links the funding update with Hyperliquid’s recent regulatory outreach in Europe, while stopping short of giving more detail on the source of the USDC or the mechanics of the buyback.

Hyperliquid policy committee urges EU to bring on-chain perpetuals under MiFID II

It also said the approach could help preserve market stability and investor protection at the same time. The update was reported by Techub News, citing Crypto Briefing. Hyperliquid policy group submits MiCA feedback to the EU, calls for a technology-neutral approach

Hyperliquid Policy Committee, or HPC, said on Oct. 1 that it had submitted feedback to the European Commission’s targeted consultation on the evolution of the Markets in Crypto-Assets framework, known as MiCA. The filing marks the committee’s first policy submission outside the United States. In its response, HPC argued that the European Union should calibrate existing financial rules rather than rebuild the regulatory framework from scratch. It said crypto asset oversight should follow principles of technology neutrality and economic substance when classifying products. The group also proposed that onchain perpetual contracts be brought under the traditional financial instruments regime of MiFID II through existing guidance from the European Securities and Markets Authority, or ESMA, without new legislation. HPC added that perpetual contracts, which rely on public central limit order book matching, differ from traditional contracts for difference, or CFDs, that involve market-maker risk warehousing. On that basis, it said strict retail restrictions designed for CFDs should not be applied mechanically. The committee also urged regulators to recognize the public and verifiable nature of blockchain data, remove duplicative reporting requirements for information already available onchain, and preserve EU investors’ access to global liquidity.
